It sounds to me like they totally misunderstood your point. Affero does
NOT "close this loophole" for hardware.

What it does is to require that you provide a means of downloading the
source code from the server (actually I think it prevents you from
removing such code if it is provided).

This doesn't help at all for the hardware case, IMHO.

I think that the APSL mechanism is useful but the APSL license itself is
not appropriate either, as it is clearly specific to software.
